• The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

• Each party shall bear its own costs and fees, except as otherwise required by applicable law or AAA rules.

10. Class Action Waiver

YOU AND BELLA MYSTRAL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

Unless both you and Bella Mystral agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

You have the right to opt out of this arbitration and class action waiver by sending written notice to bella@bellamystral.com within 30 days of your first purchase. Your notice must include your full name, mailing address, email used to make the purchase, and a clear statement that you wish to opt out.
